Welcome to HomeScout. These Terms of Service ("Terms") govern your access to and use of our real estate services, website, and related offerings. By accessing or using our services, you agree to be bound by these Terms. Please read them carefully before using our services.

1. Agreement to Terms

By using HomeScout's services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use our services.

These Terms apply to all users of our services, including property seekers, property owners, landlords, tenants, and expats relocating to Zambia.

2. Services Description

HomeScout provides real estate services including, but not limited to:

  • Property search and matching services
  • Property listings and advertising
  • Property management services
  • Rental and sales facilitation
  • Relocation assistance for expats
  • Property viewings and inspections
  • Market analysis and property valuation
  • Legal and administrative support coordination

We reserve the right to modify, suspend, or discontinue any part of our services at any time without prior notice.

3. User Obligations and Conduct

When using our services, you agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Comply with all applicable laws and regulations
  • Use our services only for lawful purposes
  • Respect the intellectual property rights of HomeScout and others
  • Not engage in fraudulent, deceptive, or misleading practices
  • Not interfere with or disrupt our services or servers
  • Not use our services to harass, abuse, or harm others

We reserve the right to suspend or terminate your access to our services if you violate these Terms.

4. Property Listings and Information

4.1 Accuracy of Information

While we strive to ensure the accuracy of property listings and information, we cannot guarantee that all information is accurate, complete, or up-to-date. Property details, availability, and pricing are subject to change without notice.

4.2 Property Owner Representations

Property owners and landlords are responsible for ensuring that their listings are accurate and comply with all applicable laws. By listing a property, owners represent that they have the legal right to advertise and rent or sell the property.

4.3 Verification

We recommend that all users independently verify property information, conduct inspections, and seek professional advice before entering into any property transaction.

5. Fees and Payments

5.1 Service Fees

HomeScout charges fees for certain services as agreed upon with clients. All fees will be clearly communicated before you commit to using a paid service. Fees are subject to change with advance notice.

5.2 Payment Terms

Payment is due as specified in your service agreement. Late payments may result in suspension of services and may incur additional charges. All fees are non-refundable unless otherwise specified.

5.3 Third-Party Fees

You are responsible for any third-party fees associated with property transactions, including but not limited to legal fees, inspection fees, and government charges.

6. Disclaimers and Limitation of Liability

6.1 Service "As Is"

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, secure, or error-free.

6.2 Limitation of Liability

To the maximum extent permitted by law, HomeScout shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount of fees you have paid to us in the 12 months preceding the claim.

6.3 Third-Party Actions

We are not responsible for the actions or omissions of property owners, landlords, tenants, or other third parties. Any disputes between users should be resolved directly between the parties involved.

7. Intellectual Property Rights

All content on our website and in our services, including text, graphics, logos, images, and software, is the property of HomeScout or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our content without our express written permission. Property listings and photographs remain the property of their respective owners.

8. Termination

We reserve the right to suspend or terminate your access to our services at any time, with or without cause, and with or without notice. You may also terminate your use of our services at any time by discontinuing access.

Upon termination, all provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

9. Indemnification

You agree to indemnify, defend, and hold harmless HomeScout, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

  • Your use or misuse of our services
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any content or information you provide

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Zambia. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Zambia.

Before filing any legal action, parties agree to attempt to resolve disputes through good faith negotiation. If negotiation fails, disputes may be submitted to mediation before pursuing litigation.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of our services after such changes constitutes acceptance of the modified Terms.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

13. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us, constitute the entire agreement between you and HomeScout regarding your use of our services.
